By accessing or using UberBayer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

UberBayer is an eBay monitoring service that searches for items based on keywords you provide and sends you email alerts when matching items are found. The Service uses eBay's public APIs and is not affiliated with, endorsed, or sponsored by eBay Inc.

3. User Accounts

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account
  • Not share your account with others

4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Abuse, harass, or harm other users or the Service operators
  • Attempt to access accounts that don't belong to you
  • Create excessive or abusive numbers of keyword alerts
  • Attempt to overload, spam, or disrupt the Service
  • Use automated tools to access the Service (bots, scrapers, etc.)
  • Reverse engineer, decompile, or attempt to extract the source code
  • Circumvent any rate limits or restrictions
  • Resell or redistribute the Service without permission

5. Service Limits

We reserve the right to impose reasonable limits on the number of keyword alerts, search frequency, and other Service features. These limits may change at any time and are necessary to ensure fair access and service quality for all users.

6. eBay Affiliate Links

UberBayer participates in the eBay Partner Network. Links to eBay items in our alerts include affiliate tracking codes. If you make a purchase through these links, we may earn a commission at no additional cost to you. This helps support the Service. You are free to search for items directly on eBay if you prefer not to use affiliate links.

7. Third-Party Services

The Service uses eBay's API and other third-party services. Your use of these services through UberBayer is subject to eBay's terms and the terms of other service providers. We are not responsible for the availability, accuracy, or content provided by eBay or other third parties.

8. No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free
  • All items matching your keywords will be found or alerted
  • eBay listings will be accurate, complete, or available
  • Email alerts will always be delivered successfully
  • The Service will meet your specific requirements

9. Snipe Assist and Deal Score Disclaimers

Snipe Assist Timing

The Snipe Assist feature sends email reminders before auction listings end. However, we cannot guarantee perfect timing or delivery. Email delivery times, network delays, server processing, and other technical factors beyond our control may affect when reminders are received. UberBayer is not responsible for missed auction opportunities, late reminders, or undelivered notifications. Users are solely responsible for monitoring their own auctions and placing bids in a timely manner.

Deal Score Accuracy

Deal scores are algorithmic estimates based on comparative price analysis and are provided for informational purposes only. These scores are not guarantees of value, savings, or fair market price. Deal score calculations may be affected by limited data availability, varying item conditions, shipping costs, seller differences, market fluctuations, and other factors. UberBayer makes no representations or warranties regarding the accuracy, reliability, or completeness of deal scores. Users should conduct their own research and due diligence before making any purchase decisions.

No Purchase Recommendations

UberBayer does not provide financial, investment, or purchasing advice. Alerts, deal scores, and other information provided by the Service are for informational purposes only and should not be construed as recommendations to buy or bid on any particular item. All purchasing decisions are made at the user's own risk and discretion.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UBERBAYER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Missed opportunities, auctions, or alerts
  • Late, inaccurate, or undelivered Snipe Assist reminders
  • Inaccurate or misleading deal scores or pricing information
  • Purchases made based on information provided by the Service
  • Unauthorized access to your account
  • Errors or omissions in any content
  • Any conduct of any third party on the Service

11. Indemnification

You agree to indemnify and hold harmless UberBayer and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms or abusive behavior. You may also terminate your account at any time by contacting us or using the account deletion feature.

13. Changes to Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. API Usage and Rate Limits

Our Service relies on eBay's API, which has rate limits and usage restrictions. We may need to limit or adjust search frequency, keyword limits, or other features to stay within these limits and ensure service availability for all users.

15. Email Communications

By using the Service, you consent to receive email alerts and service-related communications. You can disable email alerts at any time through your account settings. We will continue to send important service announcements and legal notices even if you disable alerts.

16. Intellectual Property

The Service, including its design, code, graphics, and content, is owned by UberBayer and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

17. Governing Law

These Terms are governed by the laws of the United States and the state where UberBayer operates, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of that jurisdiction.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and UberBayer regarding the Service and supersede all prior agreements and understandings.
